MCNAMARA & MCCARTHY, P.C. offers a full range of employment and family-based immigration legal services. Our commitment is to provide knowledgeable, personal and responsive representation to all our clients, who include major international corporations, small businesses, universities and schools, hospitals, religious organizations and skilled individuals throughout the Untied States. We "partner" with our clients to develop strategies to meet their immediate and long-term employment and immigration goals. We provide a high level of personalized service, seeking creative solutions to complex issues and individual circumstances. We utilize state-of-the-art technology, such as our new, secure online case management system, which provides for interactive case preparation and case status reports accessible by our clients. Our practice covers the following areas:

  • Nonimmigrant Visas. We obtain appropriate nonimmigrant visas and work authorization status, for professional and skilled employees of institutions and corporations, as well as independent investors, and distinguished scientists, artists, and athletes. We also counsel employers in developing effective strategies and processes to meet their personnel needs. For example, we have obtained approval of Blanket L Visa programs for several multinational companies, thereby reducing the time and expense required to transfer key personnel to the United States. We have also gained INS approval for company training programs to provide their foreign employees with the knowledge and skills needed for success abroad.

  • Immigrant Visas. We obtain United States permanent resident status for individuals and their families based upon their employment or distinguished accomplishments in an ever-increasing variety of fields. We have achieved an enviable record of success in labor certification applications throughout the United States, and in applications for which labor certification may be waived, including outstanding scientists, educators, business executives and artists. Evaluating each case individually, we seek solutions to meet the profiles and timetables of each client and continue to work with them, applying all laws and opportunities as they arise throughout the process.

  • Compliance and Auditing Services. We conduct training programs for in-house legal staff and personnel managers to assist in the administration of immigration-related matters, including compliance with regulatory requirements. We also help our clients develop systems to facilitate the immigration process. For example, we have worked with the Human Resources Departments of major national computer consulting firms to establish hiring and documentation procedures and internal systems to ease the complexities of the immigration process and to comply with the I-9 Employment Verification and H-1B visa regulations. We recently conducted an audit of H-1B visa records for a multinational technology company, suggested remedial actions, and developed a record keeping system to ensure compliance going forward.

  • Liaison and Advocacy Services. We act as liaison between clients and appropriate governmental agencies, such as the Department of Homeland Security, the State Department and the Department of Labor, and advocate for our clients at consular offices around the world. For example, we have developed an Exchange Visitor program for an acclaimed private educational institution, obtained program designation by United States Department of State, and then acted as liaison with respect to the maintenance of that program.

  • Foreign Visas and Work Authorization. We assist in obtaining appropriate visas and work authorizations for business travel and employment in several countries outside the United States.
